If you’re planning to order canvas prints online from Cornish Wall Art, we have a duty to disclose our terms and conditions – so here they are! It’s the boring but necessary legal bumf that makes sure both parties understand the terms of sale!

ARTICLE 1: GENERAL
The terms and conditions (“Terms”) contained within this page relate to your rights and obligations in relation to this website, located at www.cornishwallart.co.uk (“Site”) and any goods purchased through the site. Please read them carefully! You may have other rights granted by law and these Terms do not affect those. If there’s anything you don’t understand, then please contact us and we’ll be happy to help!

This Site is operated by Cornish Wall Art (“us”, “we”, “Cornish Wall Art” or “our”), located at 9 Finsbury Rise, Roche, St Austell, Cornwall.

We reserve the right to amend theses terms at any time without prior notice. Any changes will be posted to this page and will take effect immediately. By continuing to use the site you are bound by these terms.

ARTICLE 2: PRIVACY POLICY
The content within this site is owned in its entirety by us – so you’re not permitted to reuse any parts of it or to distribute any content for any purpose other than personal viewing and the printing of individual pages. We reserve the right to restrict, terminate and suspend anyone from using this site.

ARTICLE 3: SHOPPING WITH US
This site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to despatch of such goods.

By submitting your order you’re offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to third-party couriers).

We are not obligated to fulfil your order and supply your goods to you until we have confirmed that we have accepted your order and received payment in full. Your order will be deemed to have been accepted when we despatch to you the goods which form your order. We reserve the right to reject your order at any time.

The specifications, sizes, images, descriptive content and advertising published by us or contained on our site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only: they do not form part of the Terms. Actual colours may differ due to your own monitor settings, over which, of course, we have no control!

The size of frame is used as a guide on frame depth – we use ‘slim’ and ‘chunky’ as a guide, but the actual depth of these frames is 0.75inch and 1.75inch.

All pricing is subject to change without notification. Any such changes will be effective immediately on publication to the site

Reprints are at our discretion. We will not reprint an order that has been fulfilled to your requirements. If we believe the size you choose is of the wrong proportions, depth or bleed of the canvas we may alter some of the design aspects without prior notice to keep the composure of your canvas print. We would only ever do this to make the canvas better NOT worse! We will try and fulfil your requirements wherever possible.

If there is an issue with your canvas print, we must be notified within 14 days of receipt.

If your print is damaged when received we will endeavour to put this right with a reprint. We will only reprint the original file and specifications chosen and we will not accept a different file for a reprint. Canvas prints are bespoke made to order items and do NOT comply with general returns policies. We will only ever reprint faulty prints at no extra cost to the customer but no other reprint will be issued, NO exception! We will not refund a damaged print, we will only reprint it. If a reprint is issued from us we would require you to destroy the faulty canvas rather than return the canvas and send us photographic evidence that the original canvas has been destroyed. This saves the hassle of having to return the print.

If a parcel is deemed lost then our policy is to reprint the order not refund it, no exceptions. Our couriers deem a parcel lost after 14 working days. Therefore, we cannot reprint until those 14 days have passed.

If you do not intend to hang your canvas print(s) immediately then we advise storing your canvas print(s) at room temperature and to lay these on a flat surface and to avoid resting any items upon them. These are museum quality prints and must be handled with care and should not be subjected to constant handling. If you intend to display these for example at an exhibition we strongly advise transporting with care and hanging with caution in order to maintain the excellent quality the print will have been received in.

Our canvasses are not treated with any extra protective coatings or lacquers, we prefer the look, feel and finish without as do our customers. Therefore, the prints need to be handled with care to avoid any scratches to the surface of print.

All the wood we use is stored completely flat and when used for the frames is laid on a flat plate before cutting to ensure that the wood is completely straight. It is further tested during the stretching process in which the whole frame and the corners are checked. Therefore, when a canvas print leaves us we know that the frame used is perfectly straight with no warping. If the canvas arrives warped, there may have been pressure applied to the print in transit which has affected it. In this case, if you could make us aware within 7 days of purchase with a photograph of the canvas laid on a flat surface to highlight the warping and email this to us, we can then work towards rectifying the issue.

However, wood is a natural product affected by environmental conditions. Wood is susceptible to fluctuations in moisture and heat. Therefore, if the problem has developed over time it would be due to the conditions that the canvas has been stored in. We would not be able to reproduce a canvas that has been affected by the environment it is in after we have sent it and arrived with no issues.

ARTICLE 4: PRICING
All prices are the responsibility of us. We reserve the right to change them at any time. All prices include V.A.T at the current rate. We reserve the right to amend the V.A.T aspect of the prices if this changes from its current rate. Any offers or promotions are run at our discretion and are valid until the date shown or until we decide to cancel them. We reserve the right to amend or cancel any offers or promotions at any time. Any offer or promotion is only for canvas purchases unless otherwise stated.

The 3 for 2 offer is automatically applied when 3 canvas prints are added to the basket – please ensure you add 3 prints to the basket as we will not send more than than what has been ordered. 3 for 2 offer cannot be applied after the order has been placed. This promotion is only applicable for canvas prints and can be amended or cancelled at any time.

ARTICLE 5: DELIVERY
It is our aim to despatch all orders received before 2pm on Mondays to Thursdays within 48 hours of receiving the order. We reserve the right to withdraw this offer at any time or change it in any way we require without prior notice.

Any changes take effect immediately on publication to this site.

Saturday, Sunday and Bank Holidays are not included as working days.

Exact delivery dates and times are not provided. Deliveries are dispatched using a 3rd party courier. Tracking numbers will be sent via email so that you can track your order should you wish.

Dispatch timescales may extend during busy sale periods, please allow for a longer for delivery during those times.

We currently use Royal Mail and DPD Local as our couriers and reserve the right to change this without prior notice.

Delivery dates and times are for the mainland UK. Offshore deliveries are subject to longer shipping times.

We cannot be held responsible for the actions of our couriers and any delays that are incurred due to their actions. Should an order arrive later than expected due to delays incured by our third party couriers, we will not refund the order. It is up to the customer to allow for potential delays when ordering. We also recommend ordering with plenty of time to avoid disappointment.

Scottish Postcode Delivery Exceptions:

Unfortunately, we are unable to offer a next working day or weekend delivery to the following postcodes areas:

Scottish Highlands – AB36-38, AB55-56, FK17-21, IV1-39, IV52-54, IV63, KW1-14, PA21-40, PH19-26, PH30-41, PH49-50

Scottish Islands – HS1-9, IV40-51, IV55-56, KA27-28, KW15-17, PA20, PA41-49, PA60-78, PH42-44, ZE1-3 Delivery to these postcodes areas can take between 2-5 day delivery.

Once the item has left our premises, the delivery address cannot be changed. If you are not in when the item is delivered then it can only be redelivered to that address. If you want to change the address after this then there will be a £5.99 charge – but this only applies to deliveries made by DPD Local. This is down to the courier charging us for redelivery of the item: we do not make any money on redelivery, as this is the charge passed on from the courier.

In the following circumstances, we would need to take a payment of £5.99 over the phone to cover redelivery costs:

If an item fails delivery twice and requires redelivery
If an item is not collected from the delivery depot after delivery attempt failure
If the item is returned to us due to an incorrect address being given and requires redelivery
We will hold the print for reasonable time (at least 3 months) to give customers time to contact us. However, if we have had no contact after this time frame to re-despatch we will dispose of the print.

ARTICLE 6: COPYRIGHT
All copyright and intellectual property rights existing in our designs and products and in the content of the site is the property of us. Any designs where a third party has be credited with copyright will remain property of the third party with all rights reserved. By your use of the site and agreement to the Terms, you agree that you are the copyright owner, or that you have express written permission from the copyright owner, for any images you supply to us.

ARTICLE 7: ORDERING WITH US
By ordering with us or using our website (www.cornishwallart.co.uk) you are agreeing to our terms and conditions – it is down to the individual ordering to read these before placing the order.  ARTICLE 8: KLARNA

Customer Data Sharing

National and EU rules such as the GDPR sets certain limits to how and when you may share customer-identifying information with Klarna.

If you share personal data with Klarna you need to explain this in your privacy notice and link to Klarna’s privacy notice there. Below is an example of what that could look like in your existing privacy notice (the specific data categories transferred to be added, and text to be translated into your local language):

“In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.”
